Indemnity bond
1. Assumption of risk
I understand that travel and wildlife, nature and photography journeys involve inherent risks, including (without limitation) encounters with wild animals, rough or remote terrain, vehicle and boat travel, adverse weather, altitude, illness, injury, delays, and loss of or damage to property. I voluntarily choose to participate in the journey named above and accept these risks.
2. Health and fitness
I confirm that I am medically fit to take part, that I have disclosed to Kipekee Journeys any condition that may affect my participation, and that I am responsible for carrying any personal medication I need. I am responsible for obtaining adequate travel, medical, evacuation and baggage insurance for the whole journey.
3. Following instructions
I agree to follow the instructions of the skipper, guides, drivers and park or reserve authorities at all times, to maintain safe distances from wildlife, and to respect local laws, customs and the environment. I understand that I may be asked to leave an activity, or the journey, if my conduct endangers myself or others, without refund.
4. Release and waiver
To the fullest extent permitted by law, I release and discharge Kipekee Journeys, its directors, employees, skippers, guides, agents and representatives (together, the "Organisers") from all claims, liabilities, losses, costs and damages of any kind arising out of my participation in the journey, including injury, illness, death, or loss of or damage to property, except to the extent caused by the gross negligence or wilful misconduct of the Organisers.
5. Indemnity
I agree to indemnify and hold harmless the Organisers against any claim, loss, damage, cost or expense (including reasonable legal fees) arising from my own acts or omissions, my failure to follow instructions, or any breach of this bond, including any claim made by a third party against the Organisers as a result of my actions.
6. Third-party providers
I understand that accommodation, transport, park entry, activities and other services are provided by independent third parties, and that the Organisers are not liable for their acts, omissions, delays or failures.
7. Itinerary changes
I understand that itineraries, accommodation, vehicles and activities may be changed or cancelled because of weather, safety, wildlife conditions, government or park restrictions, or other circumstances beyond the control of the Organisers, and that sightings and photographic opportunities cannot be guaranteed.
8. Emergency
In an emergency I authorise the Organisers to arrange medical treatment or evacuation on my behalf, and I accept responsibility for the associated costs.
9. Governing law and acknowledgement
This bond is governed by the laws of India. I have read and understood this document, I sign it voluntarily, and I understand that it affects my legal rights, including the right to sue.
